the alleged shooter, james holmes in court yesterday. mike taibbi is live in centennial, colorado, watching that for us. what's the latest on the investigation? >> reporter: the investigation will continue, but there are only a few elements still to be investigated. the forensic scene at theater and the suspect's apartment has been completed at this point. they're still checking how it was and by what means the suspect james holmes was able to have some 50 packages filled with all the supplies that added up to his alleged arsenal, were given to him, either at an address at the university of colorado where he'd been a grad student or at his apartment about five blocks from the campus. they're talking to officials at the university about that at this point. the two moisture decisions still being made in the case is whether the prosecution will go for the death penalty. that decision will be made within 60 days after the arraignment. and at that arraignment, the second part of the story, will the defense go for an ngi, lawyers call it a not guilty by reason of insanity, but that keeps the arra

, james holmes did not materialize in a movie theater in aurora free of any relationship to law and authority and the structures of power in this country, nor did he exit those relationships and structures by murdering 12 people and injuring several dozen more. before he entered the theater, he purchased guns whether legally or illegally under a framework of laws and regulations governed and negotiated by politics. in the parking lot outside, he was arrested by a police force whose salaries, equipment, and rights were shaped and determined by politics. you cannot politicize a tragedy because a tragedy is already political. when you talk about the tragedy, you're already talking about politics. but for all that, we must be careful when a specific tragedy or event leads to a broad national conversation. the thing about a horror like aurora, the reason the whole country is talking about it and grieving over it, is that it is unusual. it is rare. and as such, it is dangerous to generalize from it. so tonight on "the rachel maddow show," we're going to try to step back a moment. it w

-year-old james holmes was arrested at the scene without resisting. he lives in aurora. investigators are searching his apartment at this hour, looking for explosives because he told them that he might have explosives in his home and his car. police are expected to hold a news conference a little later this morning. but so far, aurora's police chief says there is no evidence of any additional shooters, and the fbi says there's no indication the incident is tied to any terrorist organization. >> we've talked to a lot of witnesses this morning who have designed an absolutely terrifying scene. a man who was at the front right of the theater came in right near the right-hand part of the screen, fired something into the air, and then opened fire on the crowd. according to investigators and our own pete williams, he was heavily armed with at least four weapons on him in addition to the tear gas, he was wearing a gas mask, dressed in all black and appeared to have a bulletproof vest. >> a lot of questions because according to just about every eyewitness, he came in through an emergency exit.
